Arrest Warrant

If the debtor fails to attend the bailiff’s appointment to make a statutory declaration, the creditor can apply for an arrest warrant. The creditor can then – if required with police assistance – have the bailiff arrest the debtor.

If, following his arrest, the debtor still refuses to make a statutory declaration he will be taken into custody. The custody period is not to exceed 6 months.
