Attachment

Attachment implies the seizure of an item by the state. At the same time the creditor receives a so-called attachment entitlement (§ 804 Sub. 1 ZPO). The attachment involves three different categories:

• Attachment of physical items
• Attachment of claims or other security entitlements
• Attachment of entitlements involving the handover or provision of physical items

An attachment requires the availability of an enforcement order. This should have an enforcement clause and has to be served on the debtor.

The attachment is carried out at the creditor’s request.
