Complaint

If the debtor denies that he owes the claim made against him, then the ccreditor’s last resort is to have his claim made legally valid within the scope of a complaint procedure.

For that purpose the creditor has to file a statement of claim with the competent court. It has to include the exact description of the parties (name and address) so it can be served on the debtor.

In addition the statement of claim has to include a request exactly outlining the creditor’s claim (e.g......to sentence the debtor to pay....€ including ...% interest with effect from .... ).

The claim made has to be substantiated in detail and allegations have to be supported by evidence. The statement of claim is also to be accompanied by documents supporting the claim (e.g. invoices, or forms etc.).
