Death of creditor

If the creditor dies before he has been able to obtain from the debtor an enforceable claim, the heir can continue i.e. initiate relevant procedures.

If, at the moment the creditor dies, an enforcement order has already been issued, the heir, following introduction of the certificate of inheritance, can have the claim transferred in his name (§ 727 ZPO).
