Death of Debtor
If the debtor dies after the enforcement order has come into effect, the enforcement can be continued without a transfer of the title. The enforcement, however, is restricted to the inheritance and should not involve the heirs’ assets.
If the debtor dies before the enforcement order has become effective, the enforcement title has to be transferred to the heirs. The condition being that the heir actually wants to accept the inheritance as such, i.e. or that the exclusion date has expired. First of all one has to identify the heir and apply to the inheritance court for a will. After producing the will the enforcement title will then be transferred to the heir.
