Jurisdiction
Jurisdiction refers to the local competency of a the court.
If the debtor is a natural person then the court in whose district the debtor resides has jurisdiction. In the case of legal entities the seat of the company applies.
Apart from this general jurisdiction there are also other forms of jurisdiction such as e.g. jurisdiction with regard to domicile, capital and unauthorized actions.
If several areas of jurisdictions apply the creditor has the right to chose.
Also important are jurisdiction agreements made between the parties which often deviate from general jurisdiction rules. Jurisdiction agreements are only allowed if both parties are businesses or legal entities.
The order to pay has to be obtained from the court having jurisdiction in the applicant’s (creditor’s) place of residence or registered office of the applicant’s company.
