Legal Aid

If parties lack the financial means to pay for legal expenses either in part, in full or in instalments, they receive, upon application, legal aid (§ 114 German Code of Civil Procedure). However, in such cases it is necessary that intended legal proceedings are likely to be successful. Deliberately initiated proceedings are not supported.

The applicant has to document that he is unable to cover the costs of legal proceedings.

Applications for legal aid have to be filed with the Court of Procedure. They may also be recorded at the court’s office.
