Obligatory Lawyer

Complaints involving claims up to 5,000. - EUR are dealt with by the County Court. Claims above 5,000 - EUR are dealt with by the High Court.

Creditors bringing their claim before the County Court can represent and carry out any legal acts themselves. This is not the case with the High Court and Supreme Court where a lawyer is obligatory. (§ 78 Sub. 1 ZPO), which means that the parties have to have themselves represented by a lawyer.

This is obligatory. On the hand a lawyer is obligatory in the interest of legal requirements and on the other hand to protect the rights of legally inexperienced parties.
