Property Attachment
Property attachment implies enforced attachment of the debtor’s moveable property. Property attachment upon the creditor’s request is usually done by the bailiff on the debtor’s residential or business premises. However, it may also be possible that the bailiff attaches property in another place e.g. on a market where the debtor holds a stall.
The bailiff is entitled to a residential and container search of the debtor. Valuable property of the debtor will be attached and subsequently converted into cash.
However, creditors often have a different understanding of the debtor’s property value. Usually the bailiff does not find anything worthwhile which is partly caused by the debtor’s actual hardship but sometimes also by legal regulations inappropriately extending attachment exemptions for the debtor’s benefit.
