Reminder Procedure
By means of legal reminder procedures the creditor is able to obtain an enforcement order in an efficient and cost-effective manner.
First of all the competent court is approached to issue a legal reminder which is served on the debtor. Within two weeks the debtor may appeal against this reminder without having to introduce any related arguments.
Two weeks after serving the reminder one can apply for the enforcement order. Also in this case the debtor can appeal within two weeks following the service but again he does not have to introduce any related arguments.
If the debtor allows the time-limits to expire the creditor will be issued with a legally valid enforcement order with which he can enforce the order without any restrictions.
If the debtor, however, objects or appeals within the laid down time-limit, the creditor in order to obtain his title claim will have to bring the contested claim before the court.
