Statement by Third Party Debtor
If an attachment and transfer order is being issued, i.e. a claim to which the debtor might be entitled is being attached, then the third party debtor is obliged to make a so-called third party debtor statement including.
- whether and to what extent he acknowledges the claim
- whether and to what extent he is willing to pay
- whether and why there are entitlements regarding pre-judgment seizures
The third party debtor statement has to be made within two weeks following the service of the attachment and transfer order.
If the third party debtor does not provide the statement at all or on time or provides an incomplete statement, then the creditor shall be entitled to be compensated by him for any resulting damages.
The third party debtor cannot ask the creditor for compensation of costs involved in producing the third party debtor statement.
